Terms of Use

These terms set out the rules for using MyCal, including subscriptions, nutrition estimates and account responsibilities.

1. Agreement

These Terms of Use (“Terms”) are an agreement between you and LifeTech Pty Ltd (“MyCal”, “we”, “us” or “our”). By downloading, accessing or using MyCal, you agree to these Terms and our Privacy Policy. If you do not agree, do not use MyCal.

Your licensed use of the iOS app is also subject to Apple’s Standard Licensed Application End User License Agreement. These Terms supplement that licence and govern the MyCal service, subscriptions and your relationship with us.

2. Eligibility and accounts

You must be at least 13 years old to use MyCal. If you have not reached the age of majority where you live, a parent or legal guardian must review and agree to these Terms for you. You must provide accurate information, keep your sign-in credentials secure and notify us if you suspect unauthorised account use.

3. MyCal is an estimate, not medical advice

MyCal uses user-provided information and automated analysis to estimate calories, macronutrients and suggested daily targets. Food composition, serving size, preparation method, camera angle and AI limitations can make results inaccurate. MyCal does not guarantee that an estimate is complete, precise or suitable for your needs.

MyCal is a general wellness tool. It is not a medical device and does not provide medical, nutritional, diagnostic or treatment advice. Do not use it as a substitute for a doctor or qualified dietitian. Seek professional advice before making significant dietary changes, particularly if you are pregnant, under 18, have an eating disorder or medical condition, take medication, or have specialised nutrition needs. In an emergency, contact local emergency services.

4. Subscriptions and billing

Some or all MyCal features require an auto-renewable subscription. The available plan, billing period, full price and included features are shown in the app before purchase. Prices may vary by country and are charged in the currency displayed by the App Store.

  • Payment is charged to your Apple ID account when you confirm the purchase.
  • Your subscription renews automatically unless you cancel it at least 24 hours before the current billing period ends.
  • Apple may charge your account for renewal within 24 hours before the current period ends.
  • You can manage or cancel the subscription in iOS Settings under your Apple ID and Subscriptions.
  • Deleting MyCal or your MyCal account does not automatically cancel an Apple subscription.
  • Refund requests and billing disputes for App Store purchases are handled by Apple under Apple’s applicable rules.

We may change future subscription prices or features. Apple will provide notice and request consent where required. A price change does not alter amounts already paid for the current billing period.

5. Permission to use MyCal

Subject to these Terms and Apple’s applicable licence terms, we grant you a limited, personal, non-exclusive, non-transferable and revocable right to use MyCal for lawful personal purposes. You may not copy, sell, lease, reverse engineer, bypass security or usage controls, scrape the service, interfere with its operation, or use MyCal to create a competing model or service except where applicable law expressly permits it.

6. Your content

You retain ownership of photos, text and other content you submit. You give us a limited, worldwide licence to host, copy, transmit, process and display that content only as needed to operate, secure and improve the MyCal service and provide the features you request. This licence ends when the content is deleted, except for protected backups, de-identified information and records we lawfully retain.

You must have the right to upload your content. Do not submit unlawful content or images containing sensitive information unrelated to food tracking.

7. Acceptable use

You must not:

  • use MyCal unlawfully, fraudulently or to harm another person;
  • attempt to gain unauthorised access to accounts, systems or data;
  • upload malware or overload, disrupt or test the service without permission;
  • misrepresent automated estimates as professionally verified nutrition data; or
  • use MyCal in a way that infringes intellectual property, privacy or other rights.

8. Ownership

MyCal, including its software, design, branding, content and technology, is owned by LifeTech Pty Ltd or its licensors and is protected by intellectual property laws. These Terms do not transfer ownership to you. Feedback you voluntarily provide may be used by us without restriction or payment, but we will not identify you publicly without permission.

9. Service changes and termination

We may update, add, remove or discontinue features to maintain, improve or secure MyCal. We may suspend or terminate access where you materially breach these Terms, create risk for users or the service, or where required by law. You may stop using MyCal and delete your account at any time. Provisions that by their nature should continue after termination will survive.

10. Disclaimers and liability

Nothing in these Terms excludes, restricts or modifies rights or remedies that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. Subject to those rights, MyCal is provided “as is” and “as available”. We do not promise uninterrupted availability or that every estimate or result will be accurate.

To the maximum extent permitted by law, LifeTech Pty Ltd will not be liable for indirect, incidental, special or consequential loss, loss of data, loss of opportunity or loss arising from reliance on nutrition estimates. Where liability can lawfully be limited, our aggregate liability relating to MyCal will not exceed the amount you paid for MyCal during the 12 months before the event giving rise to the claim.

11. Apple

You acknowledge that these Terms are between you and LifeTech Pty Ltd, not Apple. Apple is not responsible for MyCal or its support, maintenance, warranties or claims, except for any obligations imposed by law or Apple’s Standard EULA. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce terms relating to the iOS licence. You represent that you are not located in a country subject to a United States Government embargo and are not on a prohibited or restricted-party list.

12. Governing law

These Terms are governed by the laws of the Northern Territory and the Commonwealth of Australia. Courts with jurisdiction in the Northern Territory may hear disputes, subject to any consumer right that allows you to bring a claim elsewhere.

13. Changes and contact

We may update these Terms. We will post the new version here and provide additional notice where a change is material. Continued use after the effective date means you accept the updated Terms, where permitted by law.
